Help With Send Appeal A Simple Guide for Parents

When your local council refuses to provide the right support, it can feel like the end of the road. But you do not have to accept the local authority s decision. You have a very strong legal right to challenge it. Appealing to the send tribunal is the best way to make sure your child gets the correct help. At SEND Family Guidance, we guide parents and young people through this complicated legal process every day. Our goal is to make a send tribunal appeal feel much less frightening and far more organized. We break down the legal jargon so you can fight for your family with total confidence.

The First tier tribunal (Special Educational Needs and Disability) is an independent national body. The judge and their expert panel look closely at the facts of your case. They decide if the council followed the law regarding a child or young person and their special educational needs. They do not work for your local council. They are totally separate. They just want to see if the rules around education health and care were followed fairly. Because they are independent, they do not care about local council budgets or staffing issues. They only care about what your child legally requires to succeed in the classroom.

The legal process starts the exact moment you receive your official decision letter from the council. This letter might refuse an ehc needs assessment. It might refuse to issue a health and care plan after an assessment has been done. Or it might give you a final ehc plan with missing support, vague wording, or the wrong school named. Once you get that letter, the legal clock starts ticking. You usually have two months from the date written on the letter to submit your paperwork. You must keep this letter safe because it proves you have the right to challenge the council.

Before you can send your paperwork to the courts, you must think about mediation. Your decision letter will give you contact details for an independent mediation advisor. You must call them to discuss your case. You do not have to actually go to a full mediation meeting if you do not want to. If you choose to skip it, the advisor will give you a mediation certificate. This certificate is your golden ticket. You must have it to lodge most tribunal appeals. If you do try mediation and it fails, you get the certificate anyway. Once you have it, you get an extra thirty days to start the appeal if your original two months have run out.

To start the legal process, you need to complete the correct appeal form. For most cases, this is called the SEND35 form. This form tells the disability send panel exactly what you are fighting for. You will need to tick boxes to show if you are unhappy with the needs section, the support section, or the school named. You must be very clear when filling this out. The judges want to see facts and expert reports. You need to prove that the educational needs and disability support your child requires is missing or wrong. Keep your answers factual and avoid using angry language against the council workers.

A massive change in the law means the tribunal now has extended powers. You can now ask the judge to look at health and social care at the exact same time as education. If your child requires specific therapies, nursing support, or help at home, you can challenge the social care needs and provision parts of the plan. This stops you from having to fight three different battles. The judge can make powerful recommendations to health and care teams to ensure your child gets complete support. It ensures a whole family approach.

Once you send your form and evidence, the tribunal will register your case. They will send you a timetable of important dates within ten working days. This timetable tells you when you need to send more evidence and when the local council must reply. It also gives you the exact date for your final hearing. I can also attend meetings alongside you where appropriate, helping to ask the right questions, challenge unclear information and ensure that conversations remain focused on your child’s needs. My role is to help parents feel confident, informed and heard, so that decisions are made in the best interests of the child.

DLA and PIP Application Support

Completing forms for Disability Living Allowance (DLA) or Personal Independence Payment (PIP) can feel overwhelming, especially when you are already managing the day-to-day needs of your child or family member.
These forms require detailed information about how a condition impacts everyday life, and many families struggle to know how to present this clearly.

I offer support with completing these applications, helping you explain your child’s needs in a way that accurately reflects the level of support required. This can include working through the form with you, helping to word responses appropriately, and ensuring the full impact of your child’s needs is recognised.

Child Needs Assessment

I offer a comprehensive assessment of your child’s needs, designed to build a clear picture of their strengths, challenges and the support they require to thrive both at home and in education. This assessment considers areas such as emotional regulation, sensory needs, learning profile, behaviour, communication, and how demands in everyday environments may be impacting your child.

The process includes gathering information from parents, discussing your child’s experiences at home and school, and observing patterns in behaviour, regulation and engagement. Following the assessment, you will receive a written report outlining key areas of need alongside practical recommendations and supportive strategies that can be implemented at home or within school.

This assessment can also help parents better understand their child’s profile, support conversations with schools, and provide useful information when considering additional support or future EHCP applications.
